First-Year Law Studies
For many students, the first year of law school is the most difficult. After completing this course, you will have developed a rudimentary understanding of contracts, criminal law, and tort law. After the first year, you will have become more adept at being a law student, and you will eventually have a much more thorough understanding of contracts, torts, and criminal law. This course is recommended for pre-law and law students seeking to understand how the principles of law tie together as a system.
A contract is formed when an offer is made, and that offer is certain, definite, unambiguous, and demonstrates to a reasonable person that an offer is being made. That offer must thereafter be accepted in a timely and authorized manner. An acceptance must be unequivocal and mirror back the same terms. There must also be a meeting of the minds, a mutual understanding. Each party must have a common understanding of the contract’s terms. There must also be a quid pro quo – something for something of value bargained for and given in exchange. This is known as consideration. In the event of a breach of contract, various legal and equitable remedies may be available to restore the injured party to the position they would have been in had the contract been executed.
Criminal Law involves the evolution of major felonies, such as the seven enumerated felonies at common law, i.e., murder, rape, sodomy, burglary, mayhem, robbery, and arson. their progression to the definitions outlined in the Model Penal Code. Criminal Law involves memorizing definitions of crimes, including the elements that must be met for a conviction. Conversely, you will also become familiar with common criminal defenses. In Criminal Procedure, you will learn about the process by which people are prosecuted within the state and federal judicial systems. Criminal Procedure is a guide to the process by which a defendant is handled through the court system and to a myriad of procedural requirements that guarantee the rights of the accused.
In tort law, you will become familiar with intentional torts and their relationship to criminal and wrongful acts and the remedies thereof. You will also learn about negligence and the elements of negligence, eg, the breach of a duty not to expose others to an unreasonable risk of harm, and that the actions were both the direct and proximate cause resulting in ascertainable damages. The damages are intended to place the injured party in the same position they would have been in had they not been harmed. Civil Procedure provides a roadmap for understanding how the civil system operates and the mandatory procedures for prosecuting a civil case in state and federal courts.

The United States Constitution is the Law of the Land
In the United States, we are a democracy governed by a constitution that establishes citizens’ rights and limits the potential for governmental overreach. The key to Democracy is sunlight and more people understanding their constitutional rights, as to who is protected and what rights are supposed to be protected. Enlightenment provides the mind’s nontangible power to influence others with facts rather than just passing on fear, as fear is the main weapon of autocrats and dictators. The most important constitutional concepts to understand and appreciate include the first three Articles, as they define the powers of what are supposed to be the three equal branches of government, the Congress, the Executive, and the Judiciary; the Bill of Rights, especially the First, Second, Forth, Fifth, Sixth, Eighth, Nineth, and Tenth Amendments; and the Fourteenth Amendment, as it defines Equal Protection, Due Process, Privileges or Immunities, Citizenship, and how the Amendment empowers the Bill of Rights through the doctrine of Selective Incorporation. These provisions of the Constitution are key to understanding the fundamentals of the United States’ Constitutional rights.
